“B” Vesting Tentative Tract Map 19186 within Planning Area 3, Subarea 3.2b, Ranch Plan Planned Community
PROPOSAL
Rancho Mission Viejo requests approval of "B" Vesting Tentative Tract Map 19186 (VTTM 19186) to subdivide a 4.67-acre site within Planning Area 3, Subarea 3.2b of the Ranch Plan Planned Community into 69 numbered lots for planned concept single-family detached dwellings, and 23 lettered lots for landscaping, open space, private streets and private motorcourts.
LOCATION
Subarea 3.2b, Lots 19 through 27 and Lot F of “A” Tract Map 19163 in the Ranch Plan Planned Community, in southeastern unincorporated Orange County, east of Legado Road and north of Cow Camp Road, within the Fifth (5th) Supervisorial District.
ENVIRONMENTAL DOCUMENTATION
The proposed project is covered by previous CEQA documentation, which includes Final Program EIR 589, which was certified on November 8, 2004; Addendum 1.0, approved on July 26, 2006; Addendum 1.1, approved on February 24, 2011; the Planning Area 2 Addendum, approved on March 27, 2013; and Addendum 3.1 approved on February 25, 2015. This finding is appropriate and complies with the intent of CEQA pursuant to the 2020 Orange County Local CEQA Procedures Manual, Section 13.1 for projects where a previous environmental document (i.e. Program EIR 589) is already in place. Further CEQA evaluation and clearances are not required for proposed “B” VTTM 19186.

SUBJECT
Public Hearing on Planning Application PA22-0104 for a Coastal Development Permit and Variance.
LOCATION
The project is located within the community of Emerald Bay at 52 Emerald Bay, Laguna Beach, CA within the Fifth Supervisorial District. (APN 053-060-92)
PROPOSAL
A request for a Coastal Development Permit and Variance in conjunction with the demolition of an existing 2,500 square foot home and the construction of a new residence with 5,750 square feet of living area on three levels and garage spaces for three cars. The Coastal Development Permit is required for the demolition of the existing home and construction of the new home with associated site grading. The Variance is requested for reduced front and rear setback of 5 feet, where the Zoning Code would require a setback of 8.35 feet utilizing shallow lot provisions (less than 75 feet deep) of the Zoning Code.

Staff recommendation is to find that the proposed project is Categorically Exempt from the California Environmental Quality Act (CEQA), under the Class 1 (Existing Facilities), Class 2 (Replacement or Reconstruction) and Class 3 (New Construction or Conversion of Small Structures) exemptions pursuant to Sections 15301, 15302 and 15303 of the California Environmental Quality Act (CEQA) Guidelines and County of Orange procedures.

The project is located within the community of Emerald Bay at 1016 Emerald Bay, Laguna Beach, CA within the Fifth Supervisorial District. (APN 053-320-73)
PROPOSAL
A request for a Coastal Development Permit, Use Permit and Variance in conjunction with the remodeling and additions to an existing two-level 3,622 square foot home. 875 square feet of new living area is proposed with an additional 32 square feet in a garage expansion. The completed project would total 5,029 square feet of living area and 531 square foot in attached garages. The Coastal Development Permit is required for the improvements to the existing home with associated site grading. The Variance is required for reduced front setback of 8 feet, where the Zoning Code would require 13.4 feet for new construction utilizing the average adjoining setbacks criteria. The existing structure has a nonconforming front setback of 8.67 feet. A Use Permit is required to permit over-height wall of 6.5 feet in the front setback area where a maximum height of 3.5 feet is otherwise required. A Use Permit is also required to allow the required third off street parking space to be uncovered.
